Samsung to Counterattack in the Netherlands – iPhone and iPad Violate 3G Technology

A new chapter of Patent War between Samsung and Apple has just started in an other country, Netherlands. In responding to restriction of Galaxy Tab in Germany, a new lawsuit was filed against Apple. It is a clear respond from Samsung as this giant has committed to fight legally with Apple. Samsung has made ​​it clear that the new legal action against Apple concerning especially but not exclusively, the latest Apple products, including iPhone and iPad. It can be concluded that all of the iDevices of Apple has violated 3G technology.

Here are what Samsung has filed to the Dutch:

European Patent (EP) 1114528 Samsung “the device for controlling a demultiplexer and a multiplexer for the matching of data rates (rate matching) in a mobile communication system, so the data according to the 3G standard wireless can be established between a mobile station, such as a mobile or tablet, and a base station. ”

EP 1478136 provides a method for controlling the speed of the uplink from mobile to base station, through which great strides to increase or decrease, which improves throughput.

EP 1097516 is for the data signal from a 3G device. And EP 1188269 relates to finally TFCI (Transport Format Combination Indicator) field that informs receiver on the data rate of the data that is transmitted by a mobile or tablet.

Samsung brings also other similar patents in contention against Apple in the courts including the United States, Britain, Germany, France, Japan and South Korea.

Samsung’s patents are so-called standard essential patents, they are actually part of the 3G and UMTS standards as laid down in the late nineties by various standardization organizations such as ETSI.

Requests from Samsung regarding the ban of Apple products in the territory of the Netherlands and would extend to five other companies involved in the distribution of Apple products. To this extent, then add the request for damages of 1 million euros in case of violation of the ban on the marketing and import of charged.

The court will get this case in  the Netherlands next Monday. Samsung seems willing to undertake similar initiatives court against Apple in the United States, England, Germany, France, Japan and South Korea. The “conflict” is increasingly reaching most part of the World especially in developed countries.
